Class Code: 8209
Per NCCI's Scopes Code Description:
Code 8209 is applied to insureds engaged in vegetable packing and includes drivers. The operations, generally seasonal in character, involve buyers who go to farms and arrange to purchase the farmers’ vegetable crops on a bulk basis. At harvest time employees of the risk classified to Code 8209 will collect the vegetables picked by the farmers’ crews and bring this produce to a central location. There, additional Code 8209 crews sort, grade, pack or otherwise prepare the vegetables for transportation to market.
Wholesale vegetable dealers who do not engage in the collection of vegetables but buy same in wholesale lots for resale to retailers are not contemplated by Code 8209. Such wholesale vegetable dealers, who may do incidental repackaging into retail size containers, are appropriately assigned to Code 8018—Store—Fruit or Vegetable Wholesale.
Code 8209 also is applied by analogy to insureds that contract to perform vacuum tube processing of packed vegetables. Cases or cartons of vegetables are stacked onto long dollies, which are moved by power units into the vacuum tube. The tube is mechanically sealed and when the refrigeration and dehydration cycle is completed, the cases or cartons are removed and conveyed to waiting railroad cars and/or trucks for delivery to buyers.
There may be insureds that engage in both Code 2105—Fruit Packing and Code 8209—Vegetable Packing operations, either during the same time period or at different times during the year due to harvesting of seasonal crops. It has been the practice to permit the assignment of both Codes 2105 and 8209 to the risk engaged in both of these operations.
If an insured qualifies for both Code 2105 and Code 8209, division of payroll may be made for employees that interchange between both operations provided proper payroll records as described in the Basic Manual are maintained.
