Class Code: 8044

Per NCCI's Scopes Code Description:

Code 8044 applies to wholesale or retail dealers or stores that principally sell furniture, including antique furniture for homes, lawns, gardens, offices, and hotels. The furniture may be sold directly from the floor of the store or ordered from catalogs and samples on display in a showroom and subsequently shipped by the store to the customer. The word furniture as used in this classification includes, but is not limited to, living room, dining room, bedroom or kitchen sets and individual pieces such as sofas, chairs, tables, beds, mattresses. chests, breakfronts, bookcases, pianos, organs and major household appliances such as refrigerators, stoves and washing machines. In addition, furniture stores may sell a minor amount of other merchandise such as bedding, carpets, linoleum, lighting fixtures, lamps, small household appliances, mirrors, pictures and kitchen cabinets.

Code 8044 is also applicable to stores that primarily sell, deliver, and install hot tubs or spas. Assign Code 8017 to pool supply dealers that sell this merchandise on an incidental basis. Assign Code 8111 to plumbing supply dealers that sell this merchandise on an incidental basis.

Code 8044 includes the following operations when they are performed by stores that qualify for this code: delivery and setting of merchandise sold at a customer’s premises and installation work necessary on that merchandise to enable it to function as intended. Work not directly related to the installation of the merchandise such as electrical wiring, plumbing or carpentry is to be separately rated.

Repair of merchandise sold which takes place on the employer’s premises or at the customer’s location is assigned to Code 8044 unless these operations qualify for a separate classification as described in Rule 1-D-3 of the Basic Manual. Separate classifications that may be applicable to service or repair departments of employers classified to Code 8044 include but are not limited to Code 2881—Furniture Assembly—Wood; Code 2883—Furniture Mfg.—Wood; Code 9519—Household Appliances—Electrical—Installation, Service or Repair; or Code 9522—Upholstering.

Code 8044 is assigned to interior decorators offering consulting services with respect to decor, colors, and materials in homes and offices when these interior decorators are employed by an employer properly classified to Code 8044 and the interior decorator also performs store sales or is exposed to installation operations. In the event that the interior decorator’s duties are exclusively those of offering advice and the interior decorator is not exposed to store or installation activities, Code 8742 is assigned to this employee. Refer to Code 9521 for alternative classification procedures for interior decorators.

OPERATIONS NOT COVERED:

   
1.    The installation of wall-to-wall carpets, linoleum and non-ceramic floor tile shall be assigned to Code 5478—Carpet, Linoleum, Vinyl, Asphalt, or Rubber Floor Tile Installation.
2.    Stores that principally sell carpets, linoleum, lighting fixtures, lamps, mirrors, pictures, or radio and television sets are assigned to Code 8017—Retail Stores—NOC or Code 8018—Wholesale Stores—NOC depending upon whether sales are primarily retail or wholesale.
3.    Stores that principally sell bedding are assigned to Code 8008—Store—Clothing, Wearing Apparel or Dry Goods—Retail or Code 8032—Store—Clothing, Wearing Apparel or Dry Goods—Wholesale depending upon whether sales are primarily retail or wholesale. Bedding refers to bedclothes such as but not limited to blankets, sheets, pillowcases, and bedspreads.

Code 8235 is applied to employers that are exclusively involved in buying, selling, and distributing kitchen cabinets and other assembled millwork products. In the event an employer does not deal exclusively in kitchen cabinets and other assembled millwork products, Codes 8017—Store—Retail or 8018—Store—Wholesale or Code 8044—Store—Furniture may be applicable to the employer. Codes 8017 or 8018 would be applicable if a store principally (not exclusively) sells kitchen cabinets and other assembled millwork products. Code 8044 would be applicable if a minor amount of these products are sold by a furniture store.

State Addendum
Massachusetts Refer to Code 8111 for stores primarily engaged in the sale, delivery and installation of hot tubs and spas. Assign Code 8017 to pool supply dealers that sell this merchandise on an incidental basis.

Repair of merchandise sold that takes place on the insured’s premises or at a customer’s location is assigned to Code 8044, unless these operations qualify for a separate classification as described in Rule IV-D-4 of the MA Manual. An example of a separate classification that may be applicable to service or repair departments of risks classified to Code 8044 is Code 9519—Household Appliances—Electrical—Installation, Service or Repair.

Refer to Code 5478—Carpet, Linoleum, Vinyl, Asphalt or Rubber Floor Tile Installation—for the installation of wall-to-wall carpets, linoleum and non-ceramic floor tile.
