Class Code: 7133

Per NCCI's Scopes Code Description:

Applies to the operation of railroads, including subways. Code 7133 does not apply to street railroads or railroads subject to the Federal Employers’ Liability Act. The determination of whether a railroad operation is covered under a state act or the Federal Employers’ Liability Act is not made by NCCI because NCCI does not provide legal opinions relating to questions of coverage. Street railroads are given the same classification treatment as bus companies, i.e., yard employees are assigned to Code 8385, the classification that applies to garage employees of bus companies, and Code 7382 is assigned to all other employees, which would include operators, drivers, or conductors.

Code 7133 principally applies to intrastate railroads that travel to and from given destinations. This classification is also assigned to the testing of high-speed railroad instruments, the operation of a test train, operating equipment and maintenance of the entire testing facility when done by the manufacturer of the product being tested in a state where the manufacturing operations are not conducted or where the manufacturing operations are self-insured.

Industrial locomotives whose operations are confined to the transit system of an industrial plant fall within the scope of the governing classification of the plant. Scenic railroads located in parks and amusement areas are classified to Code 9180.

Code 7133 operations are designated as “not otherwise classified” (NOC). These NOC operations will apply to an employer only when no other classification more specifically describes the employer’s operations.
